When a person gets into legal trouble and breaks the law, there are various consequences they can face. Fines and jail time are common penalties. A person may also be given probation or parole. These terms are often confused or interchanged with each other, but they are not the same thing. There are major procedural differences between probation and parole.

The team at Palazzo Law Firm can help you understand the difference between parole and probation and keep you out of jail. Contact an experienced New Orleans parole lawyer today to learn more about your legal rights and penalties after committing a crime in Louisiana.

What is Parole?

A person may be eligible for parole after serving a good portion of their jail sentence. You may have heard about people getting time off for good behavior. This often refers to parole. Parole is given to people who have demonstrated the ability to change their ways. They have shown they will not cause trouble and they have a strong desire to be a productive member of society once again.

Eligible offenders are released onto mandatory supervision. Some types of parole make it possible for someone to serve part of a prison sentence on parole out in the community. The person is placed under supervision and will be required to adhere to a list of strict conditions so that they cannot commit further crimes.

Conditions of release often include general rules such as obeying all laws, avoiding alcohol and drugs, not being allowed to drive, and not visiting certain areas in the community. There are more technical requirements that a person must abide by as well, such as meeting with a parole advisor, reporting for checks, and reporting any changes of residency or work location.

When a person fails to comply with any condition of release, this can constitute a parole violation. In many cases, this can cause the person to return to jail. However, this will depend on the severity of the violation.

What is Probation?

Probation is a type of punishment ordered by the court system and placed on a person who has been found guilty of committing certain crimes.

Probation can happen in two main ways. A person may serve time in jail and then be put on probation after completing a portion of the sentence. However, more commonly, offenders are given the option of going on probation instead of going to jail. If they complete the probation successfully, they can avoid jail time altogether. Probation lets a person stay in their community, as long as they’re being supervised by a probation officer. However, if they violate the terms of their parole, then they can get sent to jail.
