New Orleans Expungement Lawyer

If you have been arrested in the past, this arrest stays on your criminal record forever. There is only one way to remove it: expungement. Under Louisiana law, an expungement removes a record of arrest or conviction, as well as associated information with public access, such as photos, fingerprints, and disposition. Expungement does not mean destruction of the record.

Your criminal history is a reflection of all your arrests and convictions. If you were arrested but the charges were dismissed, the arrest will still be on your record. Every time your criminal history is checked by law enforcement or background check companies, your arrest will be revealed unless it has been expunged.

An expungement is the only way to make your criminal history confidential and remove your arrest. An expungement can be life-changing. You can do it to protect yourself from losing your job, housing, or professional license with an expungement.

The team at Palazzo Law Firm can help restore your freedom. To learn more, schedule a consultation with an experienced New Orleans expungement lawyer today.

Why You Should Get an Expungement

Employment is the most common reason for an expungement. After an expungement in Louisiana, when you apply for a job, you can legally state that you have never been arrested or convicted for any charge that has been expunged. Employers and background check companies will not have access to your expunged record and cannot be given knowledge about it.

Gun rights are another common reason for expungement. However, expungement does not always work to restore weapons rights. The law was modified in 2016 to make it so that reformed felons may receive a concealed weapons permit if they had a non-violent, non-sexual prior conviction that was expunged and it has been more than 10 years since the completion of sentence.

Sometimes banking companies will check criminal history when you apply for a loan, so an expungement can shield that information. However, keep in mind that any financial penalties streaming from a criminal conviction, such as debts, judgments, and delinquencies, can be reported to credit agencies. Insurance companies may also review criminal history when deciding whether or not to issue certain types of insurance.

When Can I Get an Expungement?

To expunge a misdemeanor conviction, you must wait five years after completing a sentence, probation, or parole. You must not have been convicted of any felony offense during this five-year period. To expunge a felony conviction, you must wait 10 years after completing a sentence, probation, or parole. You also must not have been convicted of any other criminal offense during this 10-year period.
