Metairie Traffic Violations Lawyer

Most people have received a traffic ticket at some point in their lives. Whether it was for speeding, running a stop sign, or allegedly violating some other part of traffic law, these tickets are more serious than they may seem. If you are like many others, you may simply think the best option moving forward is to pay the ticket and forget about it. However,  this is often a mistake that will not only hurt you now, but in the future, too. Below, our Metairie traffic violations lawyer explains further.

Moving vs. Non-Moving Violations

Traffic offenses are classified as either moving or non-moving violations. Moving violations occur when a vehicle is in motion. Some of the most common moving violations include texting and driving, speeding, running stop signs, drunk driving, and more. The majority of moving violations are classified as misdemeanors.

Based on its name, it is natural to think that non-moving violations occur when the vehicle is not in motion. That is not always the case. Many non-moving violations can include faulty car equipment, parking issues, failing to use a seat belt, and more. While moving violations are reported to the Department of Licensing, non-moving violations are not.

Does Louisiana Use a Point System for Traffic Violations?

Many states use a point system in which points are added to a driver’s license for certain traffic violations. When a motorist has accumulated too many points, they then lose their driver’s license either temporarily or permanently. In Louisiana, this system is not used.

Instead, the Bayou State uses the Problem Driver Pointer System (PDPS). This system is part of the National Driver Register (NDR). Under this system, if you have one or more traffic violations on your driving record, they will be visible to the authorities in other states if you travel or move. The PDPS contains a lot of your personal information, including:

  • Your name, gender, and date of birth
  • Your Louisiana driver’s license number
  • Any driver’s license suspensions or revocations you have been subject to
  • Previous cancellations
  • Any traffic violation you have committed

The PDPS will not generally cause you any trouble if you remain within Louisiana. However, previous violations could be used against you if you move to another state that also utilizes the generic point system. For example, if you have several traffic violations on your driving record, you could lose your driver’s license if you move to another state that uses the same system. While in another state, you may also have to pay higher auto insurance premiums due to multiple traffic violations.
