Metairie DUI Lawyer

Driving under the influence goes by many acronyms in Louisiana. Still, whether the offense is called a DWI, DUI, OWI, or OUI, the crime is covered under the same legal statute. The DUI laws in the state are very strict and they come with harsh penalties. Even a first-time offense can result in jail time, and you may lose your driver’s license, even if you are not convicted. It is essential that you work with a Metairie DUI lawyer who can help you avoid these negative impacts on your life and give you the best chance of beating the charges.

What is a DUI in Metairie?

As in most states, a DUI in Metairie is defined as operating a motor vehicle with a blood alcohol content (BAC) of 0.08 percent or higher. When a driver is under the age of 21 years old, they may face DUI charges if they have a BAC of 0.02 percent or higher. It is not only illegal to drive while under the influence of alcohol. Motorists who are impaired by drugs, even prescription drugs lawfully prescribed to them, can face DUI charges.

Many people wonder if they can be charged with a DUI while they are on their bicycle. Fortunately, no. The law states that for a DUI charge to apply, a person must be operating a motor vehicle. Still, being intoxicated on a bike can result in other criminal charges, such as public drunkenness or a violation of traffic law.

The Two Hearings in DUI Cases

A single DUI case will actually result in two different cases. The first is the Administrative Hearing. This hearing is not automatically set when you are charged with a DUI. You must request this hearing within 30 days from the date of your DUI arrest or you will lose the right. At the Administrative Hearing, you can request to have your driver’s license reinstated. The DMV will determine whether you should have your license reinstated based on a failure to pass chemical tests, or a refusal to take the tests.

The criminal case is the second part of your DUI case and it is entirely separate from the Administrative Hearing. During the criminal proceeding, you will argue your case to a judge and the prosecution will present evidence to try and secure a conviction. If you are not working with a Metairie DUI lawyer at this point, it is critical that you contact one before the criminal proceedings begin. A lawyer will prepare you for court, craft a solid defense on your behalf, and give you the best chance of beating the charges.
