Some people who initially survive auto accidents die later

Many Louisiana families are given hope by the fact that a family member survived a crash, even if he or she suffered serious injuries. Sadly, that hope can be taken away when that loved one dies later. The unfortunate fact is that some people who initially survive auto accidents later succumb to their injuries.

This was the case in a recent head-on collision on Louisiana Highway 107 near Louisiana Highway 3128. Reports indicate that the driver of a northbound vehicle lost control and veered into the oncoming lane of traffic. The driver attempted to move right in order to get back into the proper lane, but the vehicle in the southbound lane veered left in an attempt to avoid a collision. Those efforts were, obviously, unsuccessful.

Both drivers survived with minor to moderate injuries. An 18-year-old passenger died because of the impact. A 22-year-old passenger survived the crash and was transported to an area hospital.

However, he died the next day. In the meantime, the investigation into the accident continues. Toxicology samples were taken from both drivers to determine whether impairment contributed to the accident. It is unknown whether any charges will be filed in connection with the crash.

The families of the deceased passengers retain the right to file wrongful death claims regardless of whether any criminal charges are filed. If the evidence shows that the deaths resulted from the negligence of one or both drivers, the court could order damages to be awarded to the surviving family members. Any restitution they receive might help with the medical and end-of-life financial losses typically seen in fatal auto accidents.
