Fatal auto accidents involving children leave voids in families

Louisiana parents send their children off to school each day, expecting them to return unharmed at the end of the day. Sadly, that does not always happen. When children die in fatal auto accidents, it leaves voids in their families that can never truly be filled.

One such family recently lost a 14-year-old member. The teen was walking to school when a truck slammed into him, and he died from the injuries he suffered. The driver of the truck was taking his son to the same school to which the boy was walking and remained at the scene.

Even though local authorities do not believe that impairment or speed played a role in the boy's death, a blood sample was taken from the driver for analysis. When those results come back and the investigation is concluded, a determination as to whether charges should be filed against the driver will be made. To date, no charges have been filed.

In the meantime, the reportedly tight-knit family is trying to adjust to their loss. Family members say that his loss leaves a void in the family, which was just beginning to come back from other tragedies. The accident ended the boy's dreams of being a basketball player.

As is the right of other families who lose loved ones in fatal auto accidents, the boy's family retains the right to file a wrongful death claim in a Louisiana civil court. If the evidence proves that his death was due to the negligence of the specified driver, the court could enter an award of damages in favor of the family. Any restitution received by them could help with the unexpected financial losses associated with a premature and sudden death.
