Fatal auto accidents cast a dark shadow over the holidays

The holidays are supposed to be about spending time with loved ones, eating good food and joy. For some Louisiana families, a dark shadow is cast over the holidays by fatal auto accidents. For at least several years, that holiday will be associated with tragedy.

For example, the family of a 37-year-old Louisiana man received the news that their loved one was killed on Christmas Day. As he rode his motorcycle east on Highway 18, another vehicle headed his way from the opposite direction. The westbound vehicle failed to stay in its lane as it moved through a curve in the highway and slammed into the motorcycle.

The rider was thrown from his motorcycle and suffered severe injuries to which he succumbed. Troopers with the Louisiana State Police do not believe impairment played a role in this crash. Instead, they believe the condition of the tires on the westbound vehicle contributed to it. Troopers were confident enough in their assessment to remind motorists to maintain their vehicles and to keep tires in good working order. A decision regarding what charges, if any, will be filed against the 30-year-old driver might not be made until the investigation is concluded.

In the meantime, the victims' family's Christmas holiday was violently interrupted, and they might still be struggling to cope with his loss. Even though it will not change the events of that day, surviving family members retain the right to file a wrongful death claim in connection with the crash. If negligence on the part of the other driver is successfully established through appropriate evidence, an award of damages seen in similar fatal auto accidents could be awarded by the court.
