The reason behind a DUI stop can be pivotal to your defense

The reason the officer pulled you over is a consideration in some drunk driving cases. The officer had to initiate the traffic stop for a legal purpose. If there wasn't any other violation, such as running a red light, present, the officer must have had reasonable suspicion to suspect you were impaired in order to initiate the traffic stop.

Reasonable suspicion means that the policeman had some reason to think that you could possibly be intoxicated. This includes driving too slowly, swerving, driving in an erratic manner or speeding. Depending on other factors, such as road or weather conditions, other driving behaviors could tip off the police as well.

If an officer does initiate a traffic stop, he or she will probably ask you to take a field sobriety test or a Breathalyzer to measure your blood alcohol concentration percentage. These tests can help to determine if you are at or above the legal BAC limit.

In Louisiana, you can opt not to take a test to determine your BAC; however, refusal isn't without penalty. When you got behind the wheel, you implied your consent to these tests. As such, you might face a driver's license suspension, fines, or other consequences if you fail to take the test.
