Defense Strategies In Theft Crime Cases

At Palazzo Law Firm, our lawyers defend against shoplifting, theft by fraud, auto theft and all other theft charges. We have more than 20 years of experience defending people against these charges in Gretna, the New Orleans metropolitan area, and throughout the Gulf South region.

Severity Depends On The Value Of The Stolen Item

In Louisiana, the severity of the theft crime is based on the value of the item that was allegedly stolen. However, the penalties start high. If you are convicted of stealing an item valued at less than $ 750, you run the risk of up to 6 months in jail, longer if you have previous theft convictions. Stealing an item valued at $ 750 but less than $5000 could lead to 5 years in prison. A conviction may also require you to pay the theft victim back the full value of the item taken, commonly called restitution, plus any additional fees.

Attacking Evidence In Theft Crime Cases

Our defense strategy will be heavily influenced by the evidence against you. In theft crime cases, that evidence may include witness statements and surveillance videos. We will carefully review any video evidence. Is it clear? Does it actually show your face, or could it be anyone wearing similar clothes? Remember, the prosecutor must prove beyond a reasonable doubt that you committed that crime. Blurry videos may constitute reasonable doubt. Similarly, if a witness says you stole something, how reliable is the witness? Is this someone who has something to gain by pointing the finger at you? Did the person even have a vantage point from which he or she could see you committing the theft?

In criminal law cases involving theft by fraud, the evidence may be much more complicated but no less flawed. There may be computer files and financial documentation showing transactions, account values and more. We examine this evidence with care, finding faults and building a defense strategy. As we build our strategy, we always prepare for trial. We will fight for you, because your future is at stake. We will not stand by while you are convicted of a crime you did not commit, or you are penalized too severely for a mistake.
